Not 100% sure but only 1 can claim DEERS for them. I think it depends on who has custody of the children and where they live.
If your children live with you and your husband permantly, then your husband should be the one claiming DEERS and BAH. The Marine should be paying child support only, not collecting BAH.My husband is in the ARMY He claims my 2 kids on deers and gets BAH for them. Will their dad also get it?
That's a unique situation that needs to be addressed with both the Army and USMC Personnel and Finance Offices. It depends on who the children reside with that would determine if both parties are even able to claim BAH for the children. Your husband would still receive the same amount of BAH because of you. There is one set rate for BAH, no matter how many dependents the member claims. But for the purposes of ensuring that what each party is doing is legal, definitely check with the appropriate on-base agencies.
since your husband is the primary caregiver and the children reside with him their dad will not be eligible for basic allowance for house with dependents,
he may have a support order that says he must provide health insurance, however it should be modified because both your husband and their father are members of the military. (basically they have the same insurance, and it is being billed twice for the same participants)
he may get BAH without dependents because he does have to pay child support.
The dad has to claim them not your husband, when my hsuband was and I was dual military I claimed my kids and he claimed his (he was payign child support for his kids) around tax time he only claimed my kids on taxes. I think your husband can only claim your kids on taxes and not for BAH, because your hubby doe snot provide your kid's with the ID cards and if anyoen finds out, the **** will hit the fan and you will owe the Arkmy alot of $$$!
How does your husband get BAH for your kids? Did he legally adopt them? Is his name on their births certificates? I'm confused! He should get BAH for you being his dependent because you are married, not for his step-children!
All I can tell you is that both of them cannot have them on their DEERS and collect BAH on them. Why does your new husband need to do this. He can claim just you and still get the same BAH. Let the kids father claim them. They are his kids.
